You knew the issue of copyrighted material would end up being a big thing for Google, especially after they bought YouTube. But the battle might not be as bad as expected, at least according to Bambi Francesco of Marketwatch. She sees the major media companies looking to settle with Google.
The biggest reason the media giants don’t have much legal ground to stand on is because of the protection of the Digital Millennium Copyright Act (DMCA) safe harbor, which offers ample protection to YouTube and, frankly everyone on the Internet, according to Fred von Lohmann, senior intellectual property attorney at Electronic Frontier Foundation.
Google is counting on the mechanism of the DMCA being enough to protect them against lawsuits. And it might be, because DMCA complaints give the company a chance to remove any material that might violate the law.
In any event, the forming of a “cartel” by three or more of the world’s largest media companies shows us, once again, how Google has become so large of a threat, that companies are now making plans to deal with them. This time they may not sue, but rather try to join forces.
